You may want to add some additional information about yourself: riding ability, location and budget. All of these factors can have a bearing on the recommendations.

As you stated "all conditions even" will leave too much room for practical answers... assuming that's what you were looking for.

"All conditions even"? I'd say an Xispa...

Hola Roberto, quality is what you need to look for in a used bike. Montesa, Scorpa and Beta are the best quality bikes when they are new and that holds true for them used. They all have good motors that have proven to be reliable, the frames are top quality and they use quality components.

Just pick one of those three that is in good condition and suits your style.

As for the Xispa, there are not any used ones out there.

Has anyone been able to buy one yet?? All I've heard about where prototypes

I'm 6'6", 280#, Expert, and have been hammering my '00 Bul / Sherco in trials and endurocross and would by another any day

Most models have 'for and against's', for example the Rev3 is very well built but the '04 model suffered terribly with stator problems.

The SY250 is a brilliant clubmans bike but a true Expert may be better on a Gas Gas. etc etc.

Probably the best advice would be to choose by condition and budget. Buy the best bike you can afford and that doesn't always mean the newest. A well looked after 2005 is better than a tatty 2008 machine.
