After more than two years of judicial procedures in France, the Court of appeal (“Cour d 'appel”) of Paris has misestimated definitively the accusations of disloyal competition, parasitism and servile copy of its model of motorcycle of trial alleged by SHERCO, and that they have made difficult the entrance of XISPA in the French market. History begins in August of 2007, when XISPA announces the launching to the market of their new prototype of trial motorcycle, to a very competitive price (it enters 30 cheap 40% but that the motorcycles of the same category): the X250 cc. This announcement is followed by a judicial demand against XISPA on the part of SHERCO, that accuses of acts of disloyal competition and servile copy, among others. In parallel, XISPA is object of a denigration campaign. In 2009, in first instance, the Court of commerce of Paris decided to partially welcome the unfounded demands of SHERCO and condemned to XISPA and their French distributor, ordering also the retirement of the motorcycles of the French market. Luckyly, after the resource presented/displayed by XISPA, this criticizable decision he has been annulled by the Court of Appeal of Paris in December of 2010. The Court has followed the XISPA argumentation and has declared that XISPA has not committed acts of disloyal competition, parasitism nor servile copy of models SHERCO. This sentence of the Court is today firm and definitive. XISPA continues making and commercializing motorcycles of trial for adults, with the aim of offering the best thing to the fans of this sport: motorcycles of high performance to competitive prices and with the principles security guarantees. High Group Motor enters the shareholders of Xispa Motorbike, S.L.L with an extension of the share capital.
