There are many more like me losing over £2300 pounds. Yes I feel sorry for the staff but Mark Kemp - no. He begged for a larger deposit from people. He took my bike as part ex. We trusted him. He told us face to face how he'd look after us as he took our hard earned money. Some people lost two bikes to his lies. And Harrisons are earning from it as well as Mark still living in his house. I'm sure you will argue how great he still is but I, like many others have been royally screwed. At least take a card payment as a deposit if you know your about to go under rather than lie to people. And to ring asking for a larger deposit the week you go under knowing full well the situation. Few hundred pounds he asked for on the week of closing.. That was never going to change bvms future. But really hits most folk hard. I also know he had warnings way before this. So why keep taking the way he did knowing he was actually going to screw us all? Its harder to swallow when a company has been going for so long. You trust them. Makes it worse. Other than being former employees of BVM and therefore caught up in the whole thing themselves, they have NOTHING to do with what happened or the current situation people find themselves in. I'm watching this topic closely. I can understand the frustrations and anger, but posts like "he looks like dog s***" serve no useful purpose. I do not know Mark Kemp and never dealt with BVM but there are typically 2 routes to your situation. 1) The trader, in ignorance of how irrevocably bad his solvency position really is continues to trade in the hope things get better. 2) The trader has a fair idea the situation is irrevocable and continues to trade to keep his income coming in as long as possible. The second situation is termed wrongful trading (see 1986 insolvency act) and in continuing to take deposits the trader may be personally liable (beyond the Ltd company's liability) To claim against Mark Kemps personal assets you need to prove the second situation applies. The more victims you can produce (via TC and other media) the greater the £ involved and the easier it is to prove wrongful trading. You need to contact trading standards (usually via citizens advice) and see what their view is. You may be able to get initial free advice from an insolvency practitioner. The behaviour of far too many companies is disgraceful and I suggest TC members write to their MPs to get the law tightened on insolvent trading. I presently manage quite a significant budget and rather than allocating that budget effectively and quickly I have to spend far to much time on fraud prevention and consumer protection issues. Very low thing to do. Time is going on,but maybe there is some hope for people to get their money back. I bought and sold several bikes off him over the years since about 1983, never particularly liked him himself,but he always had very knowledgeable staff and provided a postal spares second to none. As Andy says the "New" BVM is nothing to do with Mark Kemp. fantic300r Posted August 22, 2016 Report Share Posted August 22, 2016 I never really felt the need to air myself on the TC forum but I would like to say that its a real pity that genuine trials riders have been taken advantage of by Mark Kemp some 2 x years ago and are still out of pocket. Its full of ups and downs and anger due to what's happened. I feel for others worse off than me. Let's hope people get their money back. We can only but hope.
